MUTUAL LEGAL ASSISTANCE TREATIES IN CRIMINAL MATTERS (MLATs)

Since the first U.S. bilateral Mutual Legal Assistance Treaty (MLAT) entered into force with Switzerland in 1977, MLATs have become increasingly important.

The treaties include the foreign criminal prosecutor's power to summon witnesses, to compel the production of documents and other real evidence, to issue search warrants, and to serve process. In essence, MLATs help the foreign prosecutor build a foreign criminal case against a U.S. person.

Our practice group fights MLAT requests from non-U.S. countries.
